PREMISE

The publication of the products on our site is an invitation to the customer to make a purchase proposal and this proposal will have contractual value, once formulated will involve the full knowledge and acceptance of the conditions in the rules set out below. The contract will be considered concluded with the acceptance of the proposal by VTKFUL di SOPRANO SALVATORE.

VTKFUL di Soprano Salvatore has the right not to accept the proposal without owing anything to the customer who formulated it.

The site offers for sale products to users defined as "final consumers" and to persons with VAT.

The images in the multimedia catalogue accompanying the product data sheets may not be fully representative of their characteristics, as manufacturers may make improvements to the product at any time without prior notice.

The actual finishes of the variants shown in the product data sheets may differ slightly in tone due to the video settings used by the customer.

1. CORPORATE DATA

The products purchased on www.vtkful.it are sold directly by the company, VTKFUL di Soprano Salvatore, based in Marano Di Napoli on Via U. Migliaccio snc zona P.I.P.

2. ACCEPTANCE OF THE TERMS AND CONDITIONS OF SALE

The contract stipulated between VTKFUL di Soprano Salvatore and the Customer shall be considered concluded with the acceptance of the order by the seller. Such acceptance is considered tacit unless otherwise communicated in any way to the customer after verification of the order by VTKFUL di Soprano Salvatore. By placing an order online, by telephone or by e-mail, the customer declares to have read and accepted in full the general conditions of sale and payment set out below.

The customer must keep these general conditions of sale (in accordance with the provisions of art.50 and ss of Legislative Decree 206/05) by printing a copy or saving it electronically.

3. PURCHASING PROCESS

The customer can purchase the products sold in the electronic catalogue on the site www.vtkful.it, as described in the relevant data sheets or communications via email, even after contact with the sales staff VTKFUL di Soprano Salvatore, who can send the customer personalized quotes, including selling prices, transport prices, payment methods, items in order delivery address and corresponding VAT.

The receipt of payment is confirmed by VTKFUL di Soprano Salvatore by email sent to the email address provided by the Customer. This confirmation message will contain the order number, order date, billing information and recipient of the goods, details and prices including the VAT of the goods ordered.

Only once payment has been received from the Customer will VTKFUL di Soprano Salvatore start the steps related to the production/shipping of the goods.

Any notice of non-acceptance of the order due to unavailability of the product and/or delivery times longer than those indicated in the quote/product details will be communicated promptly to the customer by phone or email. In such cases, the Customer may, alternatively, change the product, wait for the availability of the new times communicated or cancel the order requesting a refund for any amount already paid.

Any right of the Customer to compensation for damages is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the non-acceptance, even partial, of an order.

Any changes to orders already confirmed cannot be guaranteed and will be authorised by VTKFUL di Soprano Salvatore. based on the progress of production.

4. SHIPPING AND DELIVERY

Purchases made on www.vtkful.it are delivered by national and international couriers to the delivery address indicated at the time of the order. In some cases, to be verified individually, and also given the right to the customer to pick up the material ordered directly from the manufacturer's warehouses, without transport costs.

During the order process, VTKFUL di Soprano Salvatore. issues the appropriate document accompanying the material shipped (Transport Document) while the invoice will be sent to the e-mail address previously communicated by the customer. For the issuance of such documents, the information provided by the Customer at the time of the order shall prevail. After the invoice has been issued, it will not be possible to change it. Shipping costs are calculated according to the weight and size of the goods at the place of destination. The quote is without obligation and does not imply the conclusion of the order, if not after the confirmation of the same and the transmission by VTKFUL di Soprano Salvatore. of production orders to its suppliers. The Customer shall bear all import charges required by the country of destination of the goods.

The Customer can provide all the details to allow the courier to reach the place of delivery, by reporting them to VTKFUL di Soprano Salvatore. by email or telephone contact before the shipment of goods from the warehouses of manufacturers.

To facilitate the delivery VTKFUL di Soprano Salvatore. provides at the request of the customer the service of advance notice by telephone by the courier. With this service, the customer is contacted by phone by the courier to determine the day and time of delivery. In this case, it is, therefore, advisable to indicate a telephone number where you can always be reached.

Any storage costs, due to deliveries made after the delivery date set by the courier or due to the Customer's repeated failure to respond to the courier's attempts to contact him, shall be borne entirely by the Customer.

Standard delivery is made at street level.

National and international couriers make deliveries from Monday to Friday, during normal working hours regulated and indicated by them and cannot be unionized by VTKFUL di Soprano Salvatore.

No responsibility can be charged to VTKFUL di Soprano Salvatore. due to delays in delivery attributable to the carrier in charge. The products are packed with strong materials suitable to ensure optimal protection during transport. In case of receipt of goods with evident tampering and/or breakage of the packaging, the customer shall accept the goods with "RESERVE FOR DAMAGED PACKAGING", describing personally and in detail the damage on all copies of the courier's delivery receipts. Ascertained the presence of damage caused by transport, the customer must report it to VTKFUL di Soprano Salvatore. within 5 (five) days of receipt of the goods by e-mail, complete with photographic documentation of the packaging and damaged goods.

The customer who for any reason will not have followed the above indications of this contract will not be able to subsequently claim any shortage or damage caused by the carrier.

5. DELIVERY TIMES

VTKFUL di Soprano Salvatore undertakes to respect the times indicated in the production order and to try to anticipate them, except in the case of unforeseen circumstances beyond the control of VTKFUL di Soprano Salvatore.

The necessary transport time must be added to the time required to prepare the goods ex-works. Under no circumstances can the Customer consider the delivery time as binding for the conclusion of the contract concluded with VTKFUL di Soprano Salvatore.

The delivery time can be verified at any time by the customer with the operators of VTKFUL di Soprano Salvatore. by telephone or email.

Any advances or delays in delivery times indicated or provided by e-mail or telephone that are not identifiable at the time of the order, but only during the preparation or production of the same, will be promptly communicated as soon as VTKFUL di Soprano Salvatore. becomes aware of them. In any case, the customer may not be considered for claims for damages or compensation and any contractual or extra-contractual liability for direct or indirect damages to persons and/or property.

6. PAYMENT METHODS

The prices shown in the product details of articles that can be ordered online or budgeted for and the relative transport costs are always exclusive of VAT. Following the purchase process, the customer can select the following payment methods:

a. Credit card: when purchasing goods by credit card, the credit card will be debited at the same time as the online transaction is completed. VTKFUL di Soprano Salvatore reserves the right to request additional information from the customer, such as identification documents and/or proof of ownership of the credit card used. In the absence of the required documentation, VTKFUL di Soprano Salvatore. reserves the right not to accept the order.

b. Bank transfer (deposit required from 30% to 40% and the balance when the goods are ready): the method of payment by bank transfer provides for the acceptance and validity of the order, only after payment by the customer and unequivocal receipt by VTKFUL di Soprano Salvatore. of the bank transfer. The data to perform the transfer will be communicated in the order confirmation sent to the customer, both for orders sent through the portal www.vtkful.it and for orders placed by phone or email. The reason for the bank transfer must include the order number, name and surname or company name of the person placing the order and a copy of the account shall be sent by email to vthful@gmail.com.

c. Payment on delivery (down payment from 30% to 40% and balance by cash on delivery)

If you select this method, you will be asked to make an advance payment of 30% to 40% of the total amount when placing your order. Upon delivery of the goods, you will have to pay the remaining amount directly to our courier by bank draft. The payment by Cash on Delivery foresees an additional cost of 5% on the taxable amount, which will be indicated in the Order Confirmation.

7. RIGHT OF WITHDRAWAL

In the presence of a customer-consumer (private person) the right of withdrawal can be exercised according to the legislation in force.

To exercise this right the customer must, within 14 working days from the date of receipt of goods, inform VTKFUL di Soprano Salvatore. (Enter the name, geographical address and, if available, telephone number, fax number and e-mail address.) of your decision to withdraw from the contract employing an explicit statement (e.g. letter sent by mail, fax or e-mail to vthful@gmail.com) stating that you wish to make use of the right of withdrawal and indicating the order number, invoice number, code and quantity of the items, whether the withdrawal is partial (only in case of purchase of several items) or total and the bank details to obtain the refund transfer (Iban code of the invoice holder).

The goods must be returned intact in original packaging properly sealed, complete in all its parts (including packaging, internal protection, external protection, wooden pallets and any documentation and accessory equipment: manuals, assembly equipment, etc.) to the address indicated by VTKFUL di Soprano Salvatore. by courier charged by the customer.

The shipping costs for the return of the goods are charged to the customer.

VTKFUL di Soprano Salvatore, after verifying the integrity of the goods, will proceed within 15 working days from the return to re-credit the value of the product / s retaining only the amount of postage, additional services and any costs incurred for the delivery of goods to the customer and indicated in the accompanying invoice.

The right applies to the purchased product in its entirety; it is not possible to exercise withdrawal only on part of the product.

The shipment for the return of the material, until the certificate of receipt in our warehouse, and under the complete responsibility of the customer.

In case of damage to the property during the return transport, VTKFUL di Soprano Salvatore. will notify the customer (within 5 working days of receipt of the goods), to enable him to file a timely complaint against the carrier of his choice and obtain reimbursement of the value of the property (if insured), in this case, the product will be made available to the customer for its return and simultaneously will be cancelled the withdrawal request and therefore the refund. VTKFUL di Soprano Salvatore. is not responsible in any way for damage or theft/loss of goods returned by shipments not insured by the customer.

The right of withdrawal lapses completely, for lack of the essential condition of integrity of the property.

In the event of forfeiture of the right of withdrawal, the goods will remain available to the customer for collection at his expense.

The right of withdrawal can NOT be exercised in the case of the supply of goods made to measure or personalised.

The right of withdrawal can NOT be exercised if the customer is not identifiable as a private person.

It is the exclusive right of VTKFUL di Soprano Salvatore. to grant exceptions to these rules.

8. WARRANTIES

The products sold by VTKFUL of Soprano Salvatore. are covered by warranty according to Legislative Decree 206/05.

In case of a purchase made by a person defined as a "final consumer" (private person) the warranty is valid for 24 months and covers defects of conformity of the product. In all other cases, the conventional warranty is 12 months.

According to Legislative Decree 206/05, the warranty applies to products that present a lack of conformity, provided that the product itself has been used correctly in accordance with its intended use. In case of lack of conformity VTKFUL di Soprano Salvatore. will, at no cost to the customer, send the spare parts necessary to restore the conformity of the product.

The customer is required to check the goods and their operation within 5 days of delivery.

Any defects already present on the delivery of the material must be reported to VTKFUL di Soprano Salvatore. within 5 days of receipt of the same by e-mail to vthful@gmail.com, indicating the code of the article, details and photographs of the defect found.

In the event that VTKFUL di Soprano Salvatore. is not able to return to the customer a product under warranty (repair or replacement), the same may proceed to its consensual replacement with a product of similar or superior characteristics to the disputed or refund the amount paid taking into account the use of the property. In cases of replacement under warranty, VTKFUL di Soprano Salvatore. will collect the defective material for the actual verification of the defects claimed by the customer. The withdrawal will be agreed upon with the customer date and time.

The goods under warranty must be returned by the customer in the original packaging properly sealed, complete in all its parts. VTKFUL di Soprano Salvatore. will take care of organizing the return transport and delivery of replacement goods / repaired under warranty, but the transport will still be charged to the customer.

The customer must keep the original packaging and all additional documentation of the products purchased until the expiration of the warranty terms of the product.

VTKFUL di Soprano Salvatore. does not guarantee damage caused by improper use of the item.

If at the time of unloading the goods there is evident damage to the packaging it is necessary:

In any case, the customer must report the damage within 5 days of delivery. Otherwise, VTKFUL di Soprano Salvatore will not be liable for any damage.

9.PLACE OF JURISDICTION

Our Sales Contracts are governed by the laws of the Italian Republic. The Court of North Naples shall have exclusive jurisdiction over any dispute concerning or arising from the Contract or its execution.

The Customer is obliged to keep a copy of these "Terms and conditions of sale and purchase" in paper or electronic form valid at the time of the conclusion of the distance contract (receipt of customer order).
